A. Eligibility
- All employees who have worked 80 consecutive hours in Nebraska are eligible.
B. Accrual Rate
- Employees accrue one hour of paid sick leave for every 30 hours worked.
- For employers with 11-19 employees: Accrual is capped at 40 hours per year.
- For employers with 20 or more employees: Accrual is capped at 56 hours per year.
C. Effective Date
- Goes into effect on October 1st.
- Notice must be provided to employees by Sept. 15th
D. Permitted Use of Sick Leave
- 1. Self-Care
- Employee’s own mental or physical illness, injury, or health condition.
- Medical diagnosis, care, treatment, or preventative care for the employee.
- 2. Family Care
- To care for a family member with a mental or physical illness, injury, or health condition.
- To provide medical diagnosis, care, or treatment for a family member.
- Definition of “Family Member”: Includes any individual with a close association equivalent to a family relationship.
- 3. Public Health Emergencies
- Closure of the employee’s place of business.
- Closure of the employee’s child’s school or place of care.
E. Administrative Requirements (What Essential Personnel will do for employees working for you?)
- Essential Personnel will track sick time and manage the accrual of sick time.
- All hours accrued will be tracked and reported on the employee’s paystub as mandated by the State.
